Welcome to PropFlagger. By using this website, creating an account or buying anything from it, you agree to these Terms & Conditions. If you do not agree, please do not use the site. These terms include the Disclaimer, Privacy Policy, Cookie Policy and Refund Policy.
1. About the site
PropFlagger is an educational website and trading journal run by Hiron Pegu (“I”). It publishes articles, guides, journal entries and strategy notes and may let registered users keep their own private journals and let approved traders sell access to their own journals.
2. Educational content only
All content is for education and information only. It is not financial, investment, tax or legal advice and not a recommendation to buy or sell anything. Trading involves a substantial risk of loss. You alone are responsible for your decisions. Please read the Disclaimer carefully.
3. Eligibility
You must be at least 18 and able to enter a binding contract to create an account or buy anything. Do not use the site if you are barred from doing so by law.
4. Your account
- Give accurate information and keep your password confidential. You are responsible for activity on your account.
- Tell me promptly if you think your account has been misused.
- I may suspend or close accounts that break these terms or put the site or other users at risk.
5. Acceptable use
You agree not to: break the law; upload unlawful, defamatory, infringing or misleading content; post spam, signals, tips, paid-group promotions or guaranteed-return claims; attempt to access private areas or other users’ data; interfere with the site’s security or operation; scrape or copy it in a way that harms it or its authors; or use it to harass others.
6. Purchases and digital access
- Prices are shown at checkout, in the currency shown, and may include taxes where required. Payments are processed by Razorpay.
- What you buy is digital access to content for your personal, non-commercial use. It is not a licence to copy, share, resell or publish it.
- Access is for the account that bought it and may not be shared. I may withdraw access if it is abused.
- Refunds are covered by the Refund Policy.
7. Journals written by other traders
Independent traders may sell access to their own journals. Those traders are not my employees or partners. They are responsible for their content, and I do not verify their results or endorse them. Their content is educational only and subject to the Disclaimer. Sellers must also accept the Seller Terms.
8. Your content
You keep ownership of what you post (comments, journal entries, charts, notes). You give me a non-exclusive licence to store, display and process it as needed to run the site, and, for content you choose to make public or sell, to show it to the audience you chose. You confirm that you have the right to post it and that it does not infringe anyone’s rights. I may remove content that breaks these terms.
9. Intellectual property
Unless stated otherwise, the text, charts, diagrams, annotations, strategy documentation, design and code of this site belong to me or my licensors and are protected by copyright. You may quote short extracts with clear credit and a link to the original page. Please ask before republishing larger parts or using them commercially. Trademarks of third parties belong to their owners.
10. Third-party links, ads and services
The site may contain advertising and links to third-party websites and services, including Razorpay and Google. I do not control them and am not responsible for their content, products or practices. Dealings with them are between you and them.
11. No warranties
The site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, availability, fitness for a particular purpose or non-infringement. I do not warrant that the site will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental or consequential loss, or for any loss of profit, trading or investment loss, loss of data or business, arising from your use of or reliance on the site or its content. Where liability cannot be excluded, my total liability for a claim is limited to the amount you paid me for the content in the 12 months before the claim, or INR 1,000 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law.
13. Indemnity
You agree to compensate me for losses arising from your breach of these terms or your unlawful use of the site, to the extent permitted by law.
14. Changes and termination
I may change the site, its content or these terms from time to time. The date above shows the latest version, and continuing to use the site after a change means you accept it. I may suspend or end access if these terms are broken. You can stop using the site, or ask me to close your account, at any time.
15. Governing law
These terms are governed by the laws of India. Subject to any consumer rights you have under the law where you live, the courts of India have jurisdiction over disputes. Please contact me first and I will try to resolve any problem in good faith.
